Which types of personal data are processed by Kunstinkortrijk?

The personal data processed by Kunstinkortrijk have either been directly obtained from you (for example during the onboarding or contracting process or by means of the use of forms available on our websites), or have been obtained via the parties with whom Kunstinkortrijk has a contractual relationship to deliver services within the framework of Kunstinkortrijk Products (essentially your banks).

The personal data we receive from you will relate to one of the following sets of personal data:

1.     For users and customers:

  • The type of data which is required for the proper delivery of the service within the framework of Kunstinkortrijk Products, i.e.
    • Professional contact data, such as your name, your address, your phone number, your email address, your company and your job title.
    • Proof of identity: copy of the front face of your eID card, birth date and gender.
  • The type of data that are technically required to make use of Kunstinkortrijk Products. These data can, inter alia, relate to login data (logfiles, PKI identifiers), past transactions (audit trail), software information (operating system, used browser type and version), IP-addresses, website visits (cookies) and digital signatures used (certificates).

2.     For vendors:

  • The type of data which is required for the proper delivery of the goods and provision of services to Kunstinkortrijk, i.e.o   Contact data, such as your name, your address, your phone, and your email address, your company and your job title.

Kunstinkortrijk does not collect personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic data, biometric data, health data, data concerning sex life or sexual orientation, and data relating to criminal convictions and offences.

Kunstinkortrijk requests such data in order to perform the services envisaged by the contractual relationship and/or conduct business with you. Failure to provide such data, Kunstinkortrijk cannot perform such services and/or conduct business with you.


Why does Kunstinkortrijk process your personal data?

Kunstinkortrijk processes your personal data for several purposes for which Kunstinkortrijk  commits to process only those personal data that is necessary to achieve the said purpose.

1.     For users and customers:

On the basis of the performance of your contract with Kunstinkortrijk and the legitimate interests of Kunstinkortrijk of providing its services to its customers, we process your personal data for the following purposes:

  • in order to successfully deliver the services you requested. These services enable you to, for example, carry out financial transactions in a secure manner, consult invoices electronically, and apply electronic signatures to documents. To optimize our services, your personal data may also be used to ensure customer care services, improve our services and the management of the contractual relationship;
  • Kunstinkortrijk also processes your personal data for typical customer administration processes, such as the creation, collection and verification of invoices and the follow-up of payments, the exchange of correspondence in the context of the contractual relationship with the Customer. for example for the issue of invoices, for entry in directories, for identification in messages sent by the Customer and/or its Users, to assist Users and in the event of disputes;
  • Kunstinkortrijk uses the personal data for (i) fraud detection and prevention which may include some general profiling and lead to Kunstinkortrijk restricting the Kunstinkortrijk services and adopting recovery measures, as well as (ii) to address any misuse, fraud, crime or unlawful behaviour committed against or via Kunstinkortrijk services; this may include communication of relevant information to law enforcement bodies and/or to affected Kunstinkortrijk customers and partners;
  • Kunstinkortrijk also uses your contact data to keep you informed from time to time about new, similar services and products offered by Kunstinkortrijk in the frame of our direct marketing activities. If you no longer wish to receive such communication, you can always unsubscribe in a simple manner via the unsubscribe facilities, as referred to in each electronic communication;
  • In the frame of the marketing and business intelligence activities of Kunstinkortrijk, we may also register visits to our website to adapt the content of our websites to suit the needs of returning visitors better.

We may also process some personal data for compliance with legal obligations such as legal archiving and cooperation with law enforcement authorities.

2.   For vendors:

On the basis of the performance of your contract with Kunstinkortrijk and the legitimate interests of Kunstinkortrijk of providing its services to its customers, we process your personal data for the following purposes:

  • Kunstinkortrijk processes your personal data for typical vendor administration processes such as managing commercial relationships with existing and potential Sellers, order fulfillment, payment and invoicing for goods and service.

We may also process some personal data for compliance with legal obligations such as legal archiving and cooperation with law enforcement authorities.

 

How long does Kunstinkortrijk store your personal data?

Kunstinkortrijk only stores your personal data for such duration as required to ensure the fulfillment of the purpose for which it was processed. Kunstinkortrijk will destroy or anonymize all your personal data when the legally required statute of limitation period has expired.

The type of data which is required for the proper delivery of the service within the framework of Kunstinkortrijk Products will be processed for the duration of the contract and an additional 4 weeks and then legally archived typically for 10 years after the last operational contract; The type of data that are technically required to make use of Kunstinkortrijk Products are processed for maximum 30 years. Data used for marketing will only be kept for the duration of the given consent. Data of potential customers are kept for 3 years.

Data from vendors’ representative will be kept for the duration of the contract and an additional 4 weeks and then legally archived typically for 10 years after the last operational contract. Data of potential vendors are kept for 3 years.

Does Kunstinkortrijk share your personal data with third parties?

In specific cases and on a temporary basis, Kunstinkortrijk works with processors in the event this is deemed useful for the operation and delivery of Kunstinkortrijk Products and services. In such case, Kunstinkortrijk can, for example, share your personal data with your bank, IT providers, accountants, attorneys, marketing services providers and Kunstinkortrijk’s art manufacturers. Kunstinkortrijk will involve processors under strict contractual conditions. In case Kunstinkortrijk uses processors, it will verify whether the processor respects the obligations set forth in this privacy statement and implements the necessary technical and organizational measures to ensure a secure processing of your data.

 

Can you consult, rectify, restrict, object, port, or even erase your personal data?

You have the right of access to your personal data. Therefore, you can always request information about your personal data being processed by Kunstinkortrijk.

You also have the right to delete your personal data if they are incomplete, or no longer relevant and to rectify data that is no longer accurate.

You may request the restriction of the processing of your personal data or the portability of such data to the extent legally applicable. You also have the right to object to processing and to withdraw any consent that you might have given with respect to the processing of your personal data, in particular for direct marketing .

Please do note that, depending on your request, Kunstinkortrijk may not be able to provide certain services. Furthermore Kunstinkortrijk cannot always delete the requested data as there may be a legal requirement to maintain such data for a certain period.

You also have the right to lodge a complaint with the Belgian Data Protection Authority or another competent supervisory authority.

Are your personal data stored in a secure way?

Kunstinkortrijk will take all technical and organisational measures necessary to protect your personal data against abuse, destruction, loss or any other action which may compromise the secure storage of your personal data.

For these purposes, Kunstinkortrijk employs strict and extensive security checks to avoid unauthorized access to and abuse of your personal data.

Which law applies to this privacy policy?

Except in case of contrary provisions of imperative law, Belgian law applies to this privacy policy. In case of a dispute, only the courts of Brussels will be competent.

 

Can this privacy policy be changed?

Kunstinkortrijk reserves the right to change this privacy policy at any time, but will in any case do so in accordance with the applicable laws and regulations.
